What Is Eminent Domain?

Eminent domain is the government's power to take property for public use or for private use that serves a public purpose.  It traces its lineage through English common law all the way back to Biblical times when David paid Ornan for his land.  Today, the biggest fights involve private parties trying to take private property for private projects, such as commercial developments or pipelines.  Although the Virginia constitution expressly forbids this, federal laws often preempt state law, leaving Virginia landowners feeling helpless.  Our attorneys have been at the cutting edge of advancing novel legal theories to defeat unconstitutional federal laws affecting Virginia landowners.

How Much Do I Get?

You are entitled to the "fair market value" of the land that is taken or the difference between what it was worth before the taking and after.  In reality, you get what the jury awards you.  Having a team of attorneys with successful jury trial experience is critical to getting the most money possible.

Do I Have To Sell?

Not necessarily.  There are options available to landowners to try and keep their land from being condemned, but you must act quickly.  Some of your options must be exercised within very short timelines or you waive them forever.  Getting an attorney involved at the very beginning of this process is critical.

How Much Do You Charge?

That depends on what you are trying to accomplish. (1) If you want to fight the taking, we offer flat-fee or hourly rate options.  OR (2) If you don't want to fight the taking but just want to make them pay you more money for your land, we receive a percentage of the increase in the amount we get them to pay.  And, in that second scenario, if we can't get you more money than what they initially offered, you don't owe us a dime.
